WYZB/105.5 THE WOLF “BEST SEAT 7” GIVEAWAY CONTEST

      A complete copy of these rules can be obtained at the offices of WYZB/105.5 THE WOLF, Cumulus Broadcasting LLC, 225 NW Hollywood Boulevard, Fort Walton Beach, FL  32548, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address.

      WYZB/105.5 THE WOLF conduct the “BEST SEAT 7” GIVEAWAY Contest (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows:

1. No purchase is necessary.  Void where prohibited.  All federal, state, and local regulations apply.

2. To be eligible to participate and win, you must be a legal U.S. resident and at least 18 years of age.   

3. The Contest is open to the general public, except for employees, agents, representatives or affiliates of WYZB/105.5 THE WOLF, Cumulus Broadcasting LLC, Floyd’s Shrimp House, Ashley Furniture Home Store, other participating sponsors (collectively the “Contest Sponsors”), all other radio industry employees, and their immediate family members.  The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.  To be eligible listeners must have a valid social security number and working telephone number when qualifying and at the time they are selected as a prize winner; individuals who do not satisfy these eligibility and other requirements will be declared ineligible to win the Contest.
4. An individual may win an on-going contest only once per 6 month period unless otherwise specifically stated.  An individual may win other seasonal or one-time contests only once for the duration of the contest.  Only one qualifier will be allowed per family or per household for the duration of the Contest. Any individual who has previously won a prize or a combination of prizes valued at more than $600 from any Cumulus station within the past year is not eligible to participate in the Contest.
5. The Contest will begin and end on Sunday, February 6, 2011 (the “Contest Period”). 
6. One (1) Grand Prize will be awarded to the Contest winner. The Grand Prize Package is a pair of recliners and end table from Ashley Furniture Home Store valued at approximately $1,000.  Other prizes will be given away at the event, however the above prize package is guaranteed to be awarded via this contest as outlined below. 
7. Individuals can participate by completing the official 105.5 The Wolf entry form at Floyd’s Shrimp House, 1450 Miracle Strip Parkway, Fort Walton Beach, Florida, starting at 2 p.m.  Prior to the football game beginning, one entry will be selected at random and person will get to sit in “The Best Seat In The House” (recliner positioned in front of one of TVs set-up for viewing the game).  At the beginning of the 2^nd, 3^rd and 4^th quarter, one entry will be selected at random and that person will takeover the chair.  THEN DURING THE 4^th QUARTER, every time the football changes hands, another entry will be selected at random and that person then gets to sit in the chair replacing the individual before him.  This continues throughout the 4^th quarter with all entries being returned to the entry box after being selected.  The last person sitting in “The Best Seat In The House” when the game ends is the winner of the grand prize package.  Only one entry will be accepted per person and contestants must be present to win. If it is determined that the finalist is not eligible to win the Grand Prize, in the station’s sole judgment and discretion, another finalist will be selected for eligibility consultation and this process will continue on until such time as an eligible finalist is found.  In some circumstances the Grand Prize winner may be chosen the week before or the week after Sunday, February 6, 2011.    The Winner’s name may or may not be announced on the air.   
8. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner, including, but not limited to any and all sales tax.  All those who win a prize or combination of prizes valued at more than $600 during a calendar year will be issued an IRS Form 1099 to report their winnings.  All those who win a prize or combination of prizes valued at more than $600 on any Cumulus Broadcasting station will not be eligible to win another prize or combination of prizes of equal or greater value for one year thereafter.
9. All prizes are awarded “as is.” Prizes are nontransferable and cannot be sold, exchanged or redeemed for prizes or cash. 
10. WYZB/105.5 THE WOLF shall not be responsible for the failure of participating sponsors to deliver prizes or any part thereof as described herein. 
11. All entrants and winners agree that WYZB/105.5 THE WOLF, Cumulus Broadcasting LLC, and their parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives shall have no liability for any injury, misfortune, or damage to either persons or property incurred by entering, participating in, winning, or losing any contest and/or by the use or non-use of any prize received in connection with this contest.
12. All prizes must be claimed in person at WYZB/105.5 THE WOLF during regular business hours and within 10 business days of winning.   Failure to timely claim the prize will result in ownership of the prize reverting back to the station to be disposed of at its discretion, and the winner then loses all claims and rights to said prize. 
13. Proper identification must be presented by any winner to claim a prize.  As a condition to receiving the prize, the winner must present a state issued photo ID and complete the applicable winner’s paperwork, including a Winner’s Affidavit and Release, releasing the station, Cumulus Broadcasting LLC, its parent, subsidiaries, affiliates, members, directors, officers, and employees from all liability in connection with winner’s participation in the contest, acceptance, and use or non-use of the prize. This information will be notarized and copies provided to the contest winner, Buffalo Rock and the station’s corporate office in Atlanta, GA.  
14. All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of WYZB/105.5 THE WOLF to be used, disposed of or destroyed at the discretion of the station.  Further, WYZB/105.5 THE WOLF is not responsible for lost, mutilated, illegible, misdirected, late, stolen, incorrect or incomplete entries.   
15. All entrants and winners agree to give WYZB/105.5 THE WOLF and Cumulus Broadcasting LLC, and their licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish my name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason WYZB/105.5 THE WOLF deems necessary without compensation,  unless prohibited by law.  All winners release, discharge, and agree to save harmless WYZB/105.5 THE WOLF, Cumulus Broadcasting LLC and its parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives from any and all claims they may have against WYZB/105.5 THE WOLF or Cumulus Broadcasting LLC in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live.  All winners further acknowledge that Cumulus Broadcasting LLC owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to Cumulus Broadcasting LLC.
16. By participating in the Contest, each participant agrees to receive email communications from WYZB/105.5 THE WOLF regarding Station events and contests. Any participant that opts-out of these mailings will also remove themselves from the contest.  By participating in the Contest, where allowed by law, participants agree that WYZB/105.5 THE WOLF may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes. 
17. By participating in the Contest, participants agree to be bound by the decisions of WYZB/105.5 THE WOLF personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. WYZB/105.5 THE WOLF will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and WYZB/105.5 THE WOLF’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of WYZB/105.5 THE WOLF, WYZB/105.5 THE WOLF reserves the right to terminate this Contest, or make such other decisions regarding the administration or outcome as WYZB/105.5 THE WOLF deems appropriate. All decisions will be made by WYZB/105.5 THE WOLF are final. WYZB/105.5 THE WOLF may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
18. WYZB/105.5 THE WOLF reserves the right to end a contest at any time upon advanced notice to the public
19. WYZB/105.5 THE WOLF reserves the right to limit the number of times an individual may enter a contest or drawing.
20. WYZB/105.5 THE WOLF reserves the right to require contestants or their representative via written proxy to be present at drawings in order to win their prize.
