Official Contest Rules

      A complete copy of these rules can be obtained at the offices of Cumulus Broadcasting LLC, 225 NW Hollywood Boulevard, Fort Walton Beach, FL  32548, during normal business hours Monday through Friday or by sending a self-addressed, stamped envelope to the above address. 
 

   CUMULUS/FORT WALTON BEACH RADIO STATIONS will conduct registration & giveaway of Anheuser-Busch prizes (Budweiser, Bud Light & Michelob Ultra) during 2010 (the “Contest”) substantially as described in these rules, and by participating, each participant agrees as follows: 
 

1. No purchase is necessary. Void where prohibited.  All federal, state, and local regulations apply.
2. Must be a legal U.S. resident at least 21 years of age in order to participate in and win the Contest.
3. The Contest is open to the general public, except for employees, agents, representatives or affiliates of CUMULUS/FORT WALTON BEACH RADIO STATIONS (WFTW and/or WKSM and/or WNCV and/or WYZB and/or WZNS), Cumulus Broadcasting LLC, Anheuser-Busch, sponsor locations, all other radio industry employees, and their immediate family members.  The term “immediate family members” includes spouses, parents, siblings, grandparents, children, grandchildren and cohabiting significant others.  To be eligible listeners must have a valid social security number and working telephone number and/or e-mail address when qualifying and at the time they are selected as a prize winner; individuals who do not satisfy these eligibility and other requirements will be declared ineligible to win the Contest.
4. An individual may win an on-going contest only once per six-month period unless otherwise specifically stated. An individual may win other seasonal or one-time contests only once for the duration of the contest.  Any individual who has won a prize or combination of prizes valued at more than $600 from any Cumulus Broadcasting station within the past year is not eligible to participate in or win the Contest.
5. The Contest will begin Monday, May 3, 2010 and end on Friday, December 31, 2010 (the “Contest Period”). 
6. To qualify for the Contest, complete a registration form at the Cumulus Broadcasting office located at 225 NW Hollywood Boulevard, Fort Walton Beach, Florida, during regular business hours during contest period or at the announced Cumulus Broadcasting radio station registration event or register on-line via the Budweiser/Bud Light link at wksm.com, wyzb.com or wzns.com.  ONLY ONE ENTRY PER PERSON PER LOCATION WILL BE ACCEPTED.  NEED NOT BE PRESENT TO WIN.
7. Various Budweiser, Bud Light and Michelob Ultra prizes will be awarded each month via random drawing from all entries collected thus far, and continuing until the conclusion of the sweepstakes period.  Prizes include:  coolers, mini fridges, bicycles, TVs, golf bags, grills, etc.  A complete list of prizes and values will be on-file at Cumulus Broadcasting each month.
8. The winners of each prize will be randomly selected from all entries received up until that time.  Each eligible winner will be contacted by phone and/or e-mail using the information provided on official entry form.  Prizes will also be awarded each month via on-air call-to-win contests as announced on air in advance.     If it is determined that the candidate is not eligible for receipt of the prize, in the station’s sole judgment and discretion, another candidate will be selected for eligibility consultation and this process will continue on until such time as an eligible candidate is found.  In the unlikely event that no candidates are found to meet the specifications, then the prize will go un-awarded.  In the event of a tie, the winner will be determined by and at the station’s sole discretion. 
9. All State, Local, Federal and or other taxes, duties, tariffs, title fees, licensing fees, or other fees for prizes awarded become the sole responsibility of the winner.  All those who win a prize or combination of prizes valued at more than $600 during a calendar year will be issued an IRS Form 1099 to report their winnings.  All those who win a prize or combination of prizes valued at more than $600 on any Cumulus Broadcasting station will not be eligible to win another prize or combination of prizes of equal or greater value for one year thereafter.
10. All prizes are awarded “as is.” Prizes are nontransferable and cannot be sold, exchanged or redeemed for prizes or cash.  The station shall not be responsible for the failure of participating sponsors to deliver prizes as promised.
11. Odds of winning depend on a number of factors including the number of eligible entries received.
12. Neither the station nor Cumulus Broadcasting LLC, its parent, subsidiaries, affiliates, members, directors, officers, employees, agents or representatives shall be responsible for the failure of participating sponsors to deliver the prizes or any part thereof as described herein.
13. Prizes must be claimed in person at the event or at radio station during regular business hours and within ten (10) business days of winning to claim the Prize. As a condition to receiving the prize, the winner must present a state issued photo ID and complete the applicable winner’s paperwork, including a Winner’s Affidavit and Release, releasing the station, Cumulus Broadcasting LLC, its parent, subsidiaries, affiliates, members, directors, officers, and employees from all liability in connection with winner’s participation in the contest, acceptance, and use or non-use of the prize.  Failure to timely claim the prize will result in ownership of the prize reverting back to the station to be disposed of at its discretion, and the winner then loses all claims and rights to said prize.   
14. All entry blanks, forms devices and materials, as well as all the information contained on or within, gathered during the course of entry, shall become the sole property of the station to be used, disposed of or destroyed at the discretion of the station.
15. All entrants and winners agree to give the Station and Cumulus Broadcasting LLC, and their licensees, affiliates, successors, and assigns the irrevocable and unrestricted right to use, re-use, broadcast, or publish my name, city of residence, photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched or distorted in character or form, and winner’s voice, recorded or live, for any reason the Station deems necessary without compensation,  unless prohibited by law.  All winners release, discharge, and agree to save harmless Cumulus Broadcasting LLC and its parent, subsidiaries, affiliates, members, directors, officers, employees, agents and representatives from any and all claims they may have against the Station or Cumulus Broadcasting LLC in connection with the taking, production, or the use of winners’ name, city of residence, any photo, video tape, film or any other likeness, including portraits and pictures, in whole or in part, as part of a composite, retouched, or distorted in character or form and without restrictions as to any changes, transformations or alterations, and including winners’ voices, recorded or live.  All winners further acknowledge that Cumulus Broadcasting LLC owns or will own exclusively any photographs of such winners used for such purposes, including the copyrights in them, regardless of the form in which they have been or may be produced and used, and all winners assign all such ownership rights to Cumulus Broadcasting LLC.
16. By participating in the Contest, each participant agrees to receive email communications from the Station regarding Station events and contests. Any participant that opts-out of these mailings will also remove themselves from the contest.  By participating in the Contest, where allowed by law, participants agree that the Station may disclose personal information obtained from participants in the Contest to third parties and use such information for marketing and other purposes. 
17. By participating in the Contest, participants agree to be bound by the decisions of Station personnel. Persons who violate any rule, gain unfair advantage in participating in the Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. The Station will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Contest and the Station’s decisions concerning such disputes shall be final. If the conduct or outcome of the Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of the Station, the Station reserves the right to terminate this Contest, or make such other decisions regarding the administration or outcome as the Station deems appropriate. All decisions will be made by the Station are final. The Station may waive any of these rules in its sole discretion. ANY ATTEMPT BY A CONTESTANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY CIRCUMVENT, DISRUPT OR DAMAGE ORDINARY AND NORMAL OPERATION OF THIS CONTEST, TELEPHONE SYSTEMS OR WEBSITES, OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, STATION RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PARTICIPANT TO THE FULLEST EXTENT PERMITTED BY LAW.
18. A list of winners may be obtained after December 31, 2010, by sending a self-addressed stamped envelope to the following address:

Sweepstakes Official Rules
 

1.  No Purchase Necessary.  Sweepstakes open to residents of U.S. (except California) who are 21 years of age or older.  Void where prohibited.  
 

The Sweepstakes contesting is managed by Cumulus Broadcasting LLC/Fort Walton Beach Radio Stations (WFTW and/or WKSM and/or WNCV and/or WYZB and/or WZNS) who has sole responsibility for contesting, prizes, contacting winners, prize awards, prize acceptance forms, and tax related reporting.  The radio company will supply a complete list of contest awards monthly, including dates, prizes and winners names, addresses, and phone numbers. 
 

2.  Sweepstakes begins at 3:00 p.m. Central Daylight Time (CDT) on May 1, 2010, and ends at 3:00 p.m. CDT December 31, 2010 (“Sweepstakes Period”) 
 

3.  Participating radio station determines ways to enter and win which include station website registration, texting per station direction, on-air and on-site registration, and call to win. 
 
 

4.  No mechanically reproduced or photocopied entries permitted. Neither the sponsor nor its agencies are responsible for lost, late, misdirected, unintelligible, returned or undelivered entries, telephone calls, email, or for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, or other connections availability, accessibility or traffic congestion, miscommunications, failed computer, network, telephone, satellite or cable hardware or software or lines, or technical failure, or jumbled, scrambled, delayed or misdirected transmissions, computer hardware or software malfunctions, failures or difficulties, or other errors of any kind whether human, mechanical, electronic or network.  Persons who tamper with or abuse any aspect of this sweepstakes or website, or act in violation of the Official Rules, or act in any manner to threaten or abuse or harass any person, or violate website’s terms of service, as solely determined by the sponsor, will be disqualified.  Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information whether caused by website users, tampering, hacking, or by any of the programming or equipment associated with or used in this sweepstakes, and assumes no responsibility for any errors, omission, deletion, interruption or delay in operation or transmission or communication line failure, theft or destruction or unauthorized website access.  Any use of robotic, macro, automatic, programmed or like entry methods will void all such entries, and may subject that entrant to disqualification.  Neither Sponsor nor its agencies are responsible for injury or damage to participants’ or any other person’s computer or property related to or resulting from participating in this sweepstakes.  Should any portion of sweepstakes be, in the sponsor’s sole opinion, compromised by virus, worms, bugs, unauthorized human intervention or other causes which, in the sole opinion of the sponsor, corrupt or impair administration, security, fairness or proper play of this sweepstakes, or submission of entries, sponsor reserves the right at its sole discretion to suspend, modify or terminate the sweepstakes, and randomly select the winners from valid entries received prior to action taken, or otherwise as may be deemed fair and equitable by the sponsor. Text message entries will be deemed to have been submitted by the registered owner of the wireless number used to enter.  In the event of a dispute regarding the identity of an online entrant, the authorized subscriber of the email account used to enter will be deemed to be the entrant, and must comply with these rules.  The authorized account subscriber is the natural person who is assigned the email address by the ISP or other organization responsible for assigning email addresses.    All materials submitted become the property of Anheuser-Busch, Inc. and will not be returned. 
 

5.  Winners will be selected in random drawings and other methods to be held between May 1 and December 31, 2010 from among all eligible entries received by the radio station whose decisions are final in all matters relating to this sweepstakes.  Winners will be notified by phone and/or mail.  Winner may not substitute or transfer prize, but sponsor reserves the right to substitute prize with a prize of equal or greater value.  Limit one prize per household. 
 

6.  All prizes will be awarded.  Odds of winning depend on the number of eligible entries received.  Winner will be notified by phone, mail or email.  If a randomly selected winner participated via Text Message, he/she will be required to respond to a phone call or text message within five (5) days in order for the independent judging agency to capture winner’s name and address or prize will be forfeited.   Sponsor is not responsible for suspended or discontinued wireless service which may result in potential winner not receiving initial prize notification.  Winner will be required to complete, sign, and return an affidavit of eligibility and liability and publicity release within seven (7) days of prize notification.   In the event of noncompliance within any of these time periods, prize will be forfeited and an alternate winner selected.  Any alternate winner selected will also be required to adhere to the time periods described herein.  Any prize notification or prize  returned to the Sponsor or its agencies as undeliverable will result in disqualification and the awarding of that prize to an alternate winner. 
 

7.  Employees and the immediate families of employees of Anheuser-Busch, Inc., its affiliates, subsidiaries, advertising and promotion agencies, wholesale distributors, and individual retail licensees are ineligible.  This sweepstakes is subject to federal, state and local regulations.  Taxes, if any, are solely the responsibility of the winner. 
 

8.  Acceptance of prize offered constitutes permission to use winner’s name, voice, biographical information and/or likeness for purposes of advertising and promotion without further compensation in all media now known or hereafter discovered worldwide and on the Internet without notice or review or approval as permitted by law.
